Non-parametric methods, including classical distribution-free and modern curve smoothing, bootstrap and semi-parametric models enable researchers to make sound inferences while relying on few assumptions. These procedures are especially appropriate for the analysis of data in legal cases and public policy because the sample sizes are often limited. The insight non-parametric methods can provide will be discussed using data from actual cases and policy decisions. For example, the semi-parametric Cox proportional hazards model will be used to determine liability and estimate economic damages in promotion discrimination cases. Conversely, statistical methods that were developed to answer questions that arose in these areas will be described and areas where further research is needed will be noted.
