Under Rule 23(a)(2) a party seeking class certification must show there is a question of law or fact common to the class. The plaintiffs in Wal-Mart showed that regression analyses of salary data for each region of the country indicated a significant female shortfall. In contrast, the defendant examined the data for the main departments at each store and found statistical significance in only 10% of them. It will be seen careful analysis of the defendant's summary of its regression results would have supported the plaintiffs' case. Other statistical aspects of the majority and minority opinions will be noted.
