Title: On Forensic Decision Analysis

One question that recurs in various guises across many types of civil litigation is "Why did they do that?" We approach this question by striving to recreate the decision alternatives reasonably available to the decisionmakers at the time and comparing the choices made to those alternatives. This leads to a variety of statistical and nonstatistical models, depending on the underlying circumstances. We illustrate some of the possibilities using case studies from jury selection, political redistricting, employment discrimination, and computer code plagiarism.
